Terms of Service

1. Agreement to terms

By accessing or using ARK OS — including the landing site, Portal, and any other app in the suite — you agree to be bound by these Terms of Service. If you don't agree, don't use the service.

2. The service

ARK OS is a connected suite of operations software for distribution businesses. Portal (order tracking) is live today; additional apps (Chat, Submittal Builder, Quotations, Buy Desk) are planned and will be governed by these same terms once released.

3. Accounts

Access is provided to authorized users of a customer account through Portal's shared sign-in. You're responsible for all activity that occurs under your signed-in session, and for keeping your credentials confidential.

4. SMS / text messaging program

If you check the box at signup or checkout to opt in, you agree to receive recurring automated text messages from Main about your order and shipment status, sent to the mobile number you provide. Consent to receive these messages is not a condition of any purchase.

Message frequency varies based on your order activity. Message and data rates may apply. Reply HELP for help, or email . Reply STOP at any time to opt out; you'll receive one final confirmation message and no further texts. Carriers are not liable for delayed or undelivered messages.

5. Acceptable use

You agree not to misuse the service — including attempting unauthorized access to any account or system, interfering with normal operation, or reverse engineering any part of the software.

6. Intellectual property

The ARK OS name, marks, and underlying software are the property of Main Electric Supply. Nothing in these terms grants you rights to our intellectual property beyond what's needed to use the service as intended.

7. Third-party services

Portal and other apps in the suite may link to or integrate with third-party services. We don't control those services and aren't responsible for their content, availability, or practices.

8. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service, including SMS delivery, will be uninterrupted, timely, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Main's total liability arising out of or relating to these terms or the service will not exceed the greater of (a) the amount you paid to Main in the 12 months before the event giving rise to the claim, or (b) $100. Main will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, even if advised of the possibility of such damages.

10. Termination

We may suspend or terminate access to the service for any account found in violation of these terms.

11. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the service will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction there.

12. Changes to these terms

We'll update the effective date above when these terms change, and post material changes here before they take effect.
